Shoplifting

No matter how serious the allegation, Krizman Law handles all levels of theft charges: municipal theft, misdemeanor theft, felony theft, burglary, robbery, motor vehicle theft, and motor vehicle trespass.

Prosecutors attack even the most basic theft crimes such as shoplifting and petty theft. Whether the allegation is taking something from a private individual or a retail store or business, prosecutors take theft crimes extremely seriously. Many stores, like Wal-Mart, Costco, and Target, have loss prevention officers on duty trying to catch shoppers in the act.

Colorado classifies thefts based on the value of the thing alleged to have been stolen. Below is a list of the classifications and their penalties:

Class 2 Misdemeanor Theft

When the property stolen is worth up to $500. Penalties for a class 2 misdemeanor include a possible jail sentence from 3 to 12 months and a fine from $250 – $1,000.

Class 1 Misdemeanor Theft

When the property stolen is worth between $501 and $1,000, theft is a class 1 misdemeanor. Penalties for a class 1 misdemeanor include a possible jail sentence from 6 to 18 months and a fine from $500 – $5,000.

Class 4 Felony Theft

When the property stolen is worth more than $1,000 but less than $20,000, theft is a class 4 felony. Penalties for a class 4 felony include a possible prison sentence from 2 to 6 years and a fine of $2,000 – $500,000.

Class 3 Felony Theft

When the property stolen is worth more than $20,000, theft is a class three felony. Penalties for a class 3 felony include a possible prison sentence between 4 and 12 years, with a minimum of years of parole and a fine from $3,000 to $750,000.
