The Supreme Court just made it harder for the federal government to charge a gun owner with a felony for using marijuana.
The case is United States v. Hemani, decided 9-0 in June 2026. Casey Krizman calls it the Court cleaning up a mess nobody realized was sitting on the books.
A Law That Made Felons Out of Everyday People
Under federal law, simply being a marijuana user who also owned a gun could trigger a felony charge. Not using the gun while impaired. Not even possessing it at the same time as the drug. Just the combination of two legal facts about a person’s life.
What the Supreme Court Actually Decided
The Court ruled that prosecuting a marijuana user for owning a gun, based on status alone, violates the Second Amendment. The defendant in the case kept his gun locked up at home. He wasn’t accused of being impaired or dangerous when he had it. The government’s only evidence was that he used marijuana and separately owned a firearm.
That wasn’t enough, the Court said. The ruling doesn’t erase the statute. It raises the bar. Prosecutors now need to show an actual link between drug use and danger, not just the coincidence of two facts about someone’s life.
What This Means If You Use Marijuana and Own a Firearm
