Assault and Leaving the Scene – Deferred Judgment and Future Record Sealing

A traffic altercation resulted in our client being charged with assault and leaving the scene of an accident. Krizman Law’s investigation proved the other driver was lying.

While driving through Golden on his way to Boulder, another driver behaved recklessly in a construction zone. As lanes narrowed, the other driver refused to allow our client to merge safely, forcing him toward the shoulder. Both drivers pulled over and exchanged heated words. During the confrontation, our client briefly restrained the other driver when he appeared to be approaching his vehicle. He then left the scene, believing the matter was over.

Later, police contacted our client after the other driver claimed there had been an assault and a hit-and-run. But our investigation showed that vehicle damage occurred before the date of the altercation and the transferred paint matched the parking barriers at our client’s apartment complex.

Krizman Law contested the insurance claim, prepared our client for a recorded statement, and submitted follow-up documentation to prevent any admission of fault. When the case reached Golden Municipal Court, we were able to secure a deferred judgment with minimal conditions.
