In this episode, Defense Attorney Casey Krizman interviews Eric Faddis, an attorney who successfully defended a father who was wrongfully accused of killing his infant daughter. The baby suffered from an undiagnosed skull fracture since birth. When she died weeks later, the police and District Attorney jumped to the conclusion that the father did it.

Police investigators and their medical experts had tunnel vision, Faddis said. Even when forensic pathologist Dr. Jane Turner determined that the baby suffered a skull fracture at birth and died weeks later due to bleeding in the brain, District Attorney George Brauchler refused to back off prosecution. The father, Shaun Jones, had to fight for his innocence in court. A jury found him innocent of all charges.

The case demonstrates how anyone can get sucked into the injustice system because prosecutors are more interested in “winning” than in justice. Faddis and Krizman discuss ways to level the playing field, such as employing independent medical reviewers to evaluate complex medical cases.
