Episode #5: Caging people is back in style

For the first time in 22 years, Colorado faces the prospect of having to build more prison cells. It’s not because crime is up. It’s because the governor isn’t following the rules to release inmates who are ready to return to the community.

Prison reform advocate Kyle Giddings tells defense attorney Casey Krizman that “tough-on-crime” politics is back and that it’s time to answer with facts and proven alternatives to caging people. Giddings encourages justice advocates to join the No More Prisons Coalition being organized by the Colorado Criminal Justice Reform Coalition.

The most urgent action is to attend the Sept. 22 meeting of the legislature’s Joint Budget Committee to oppose the prison system’s request for millions to build more cells, Giddings said.

In Episode 5 of the Criminal INjustice podcast, Casey and Kyle review CCJRC’s 25-year impact—sentencing reform that closed seven prisons. Giddings outlines the 2018 Prison Population Management law, which moves people within 30 days of parole or mandatory release back to the community when prisons come within 3% of capacity.

The episode shows how technical parole violations, not felonies, are swelling prisons, overwhelming treatment programs, and taxing guards, therapists, and parole officers.

Krizman and Giddings challenge “tough-on-crime” measures that are proposed for the 2026 ballot. They would increase the sentences and number of people caged for fentanyl possession and theft, and make it harder for people accused of a crime to bond out of jail before trial. Instead, they champion root-cause investments: housing, jobs, treatment, reentry, violence prevention, and support for underserved victims.
