Last December, the Colorado Supreme Court ruled that municipalities cannot sentence defendants more harshly than the state would for the same offense. Cities across the state are huddling to see how much they can get away with under this ruling.
Three Denver City Council members are doing the right thing: Proposing changes in Denver sentences that bring the city in line with both the Supreme Court’s mandate and basic due process. The bill caps sentences at 10 days for lower-level misdemeanors and petty offenses, with higher-level violations carrying sentences consistent with comparable state charges. This is not soft on crime. It is equal treatment under the law.
Opponents will claim the bill hamstrings cities’ efforts to combat retail theft rings. That argument does not hold. Organized retail theft is a felony. Those offenders can and should be charged at the district court level, not municipal court.
There is a larger issue at play. Law enforcement has long favored municipal court over state court because municipal sentences tend to be harsher, and oversight is thin. Capping those sentences pushes cases into district court, where judges are vetted, appointed by the governor, and held to a more rigorous standard.
Denver’s residents deserve the same treatment as defendants anywhere else in Colorado. Contact your City Council member now and demand that the city follow Supreme Court law and treat its citizens fairly.
