The client in this case was homeless and has schizophrenia. When he’s in Colorado, he lives in the city of Denver, but at night, he goes to Arapahoe County so he can sleep because he feels like people (real or perceived) chase him.
As he was going to the park at night to sleep, another homeless man at the bus station who was riding on a bicycle came close to him, and our client thought he was chasing him, so he took out a knife and popped the tire on the bicycle.
The man on the bicycle then chased our client to the park, took out his own knife, found our client, and stabbed him in the back.
Shockingly, our client was arrested and charged with felony assault for simply popping the other man’s bicycle tire, yet the man who stabbed our client in the back received no charges, and his case was dismissed.
In addition, the prosecutors then insisted that our client apologize to the man who stabbed him and pay for his therapy (ostensibly for the trauma he went through while stabbing our client).
Unfortunately, our client was indigent and couldn’t afford bail, so he spent 45 days in jail until his mother (in another state) bonded him out and, out of concern for his safety, brought him to live with her on the East Coast.
After many months of waiting, the prosecution finally decided to put him on a diversion program in which he has to apologize for popping the bicycle tire, and then pay restitution (which was reduced from $1,600 to $65).
In the end, through this diversion program, he apologized, performed some community service, and paid for the bike tire. He didn’t have to enter a guilty plea or go on probation.
While the other man will receive no consequences for stabbing our client in the back with a knife, our client will receive some justice in that his case will be dismissed, and his record will be sealed.
