Even after the state Supreme Court ruled that Aurora’s sentencing law was too harsh, the city prosecutor pressed ahead on our case. We were able to negotiate an outcome that made the prosecutor look good, but which achieved a just result: 10 days of jail that were “suspended,” meaning she will not serve a single day if she doesn’t re-offend.
Aurora’s law was harsher than state law, and the Supreme Court said that is a violation of the state constitution. We have learned through experience that one-size-fits-all sentencing does not reduce crime. These supposed “tough-on-crime” measures also eliminate alternative paths to justice.
