Police found a gun, owned by our client’s wife, in the console of his truck after stopping him outside a truck rally where drinking and reckless gun use were rampant. The police encountered him outside his truck, not in the driver’s seat. Because he had been drinking, prosecutors charged him with Unauthorized Possession of a Firearm, often called “drunk with a gun.” A conviction would have carried serious immigration consequences, as our client was undocumented.
