Police found a gun, owned by our client’s wife, in the console of his truck after stopping him outside a truck rally where drinking and reckless gun use were rampant. The police encountered him outside his truck, not in the driver’s seat. Because he had been drinking, prosecutors charged him with Unauthorized Possession of a Firearm, often called “drunk with a gun.” A conviction would have carried serious immigration consequences, as our client was undocumented.

We presented the facts to the prosecutor’s supervisors and were able to make the charge diversion eligible. That meant our client did not have to enter a plea. After completing program requirements, the case was dismissed in full, sparing him both a conviction and potential immigration catastrophe.
Despite our efforts, the police refused to return the seized firearm due to a clerical error. Still, our client is free and appreciative of our relentless efforts on his and his family’s behalf.
