This was a domestic violence case where the police were called to a house shared by a man and woman. The woman claimed that the man was hurting her, and she fought back in order to defend herself.
The woman initially contacted us, but since the man was the one arrested and not her, we referred her to a different attorney (to avoid a conflict of interest) so we could represent the man.
This was a classic instance of “the prisoner’s dilemma,” where the victim, not the perpetrator, was arrested because he was afraid to tell the police about what had really happened. The man had clammed up during the police visit and refused to speak or explain himself, so the police could only go off of the initial story the woman gave since she was the one who called and claimed he had been violent with her.
After our investigation, it became clear that the man had actually been the victim of domestic violence, not the woman.
The man had been arrested even though the woman had no marks or bruises at all. Police officers made their best judgment at the time, but the facts discovered when the dust settled made clear that any actions the man took were in self-defense, and the woman had been lying to the police to protect herself in the moment.
Krizman Law put the facts of the case together and helped the DA learn what had actually happened. The DA reached out to the woman’s attorney, who confirmed that the woman had no desire to participate in any prosecution.
In the end, Krizman Law was able to secure a dismissal of the case, and the client’s record will be sealed.
